2. Purpose and scope

This Legal Notice provides the mandatory legal information about the operator of the website golova.ai and regulates access to and use of the related services operated by Golova Europe SL (the “Services”).

Access to the Services confers the status of “User” and implies full acceptance of the provisions of this Legal Notice in the version published at the time of access, as well as the User Agreement, the Privacy Policy and the Cookie Policy.

3. Activity

Golova Europe SL operates a Software-as-a-Service (SaaS) platform for the management of equipment rental and event production businesses, together with related solutions (Golova.work, Golova.wiki, Golova.market). The activity does not require prior administrative authorisation under Spanish or EU legislation applicable to the SaaS sector.

4. Hosting

The golova.ai website is hosted on the infrastructure of the following providers:

  • Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany — server hosting in ISO/IEC 27001 certified data centres in Helsinki, Finland (EU);
  • Cloudflare Inc., 101 Townsend Street, San Francisco, CA 94107, USA — CDN and cyber-attack protection services.
5. Intellectual and industrial property

All content of the Services, including without limitation texts, photographs, graphics, images, icons, software, source code, design, navigation structure, databases and trademarks (in particular the “Golova” name and figurative elements), is the property of Golova Europe SL or its licensors and is protected by Spanish, European and international intellectual and industrial property law.

Without the prior, express written authorisation of Golova Europe SL, the User is not entitled to reproduce, distribute, publicly communicate, transform or modify any of such content, in whole or in part, in any medium, except as permitted by law.

“Golova” is a trademark and trade name of Golova Europe SL. Other trademarks appearing in the Services are the property of their respective owners and are used in accordance with applicable law and the corresponding licences.

6. Conditions of use

The User undertakes to use the Services and their content in accordance with the law, this Legal Notice, public order, good practice and good faith. In particular, the User undertakes not to:

  • Use the Services in a manner contrary to Spanish, European or other applicable legislation, or in a manner that may harm the rights and interests of third parties;
  • Engage in conduct that may damage, disable, overload or deteriorate the Services or prevent their normal use by other Users;
  • Introduce or disseminate computer viruses, malware or any other harmful element;
  • Attempt to access the Services in an unauthorised manner or interfere with their security measures;
  • Use the Services for unsolicited commercial communications or for any purpose contrary to the LSSI-CE or applicable consumer protection legislation.
7. Limitation of liability

Golova Europe SL provides the Services “as is” and uses reasonable efforts to ensure their proper functioning. To the extent permitted by applicable law, Golova Europe SL is not liable for:

  • Service interruptions caused by force majeure, telecommunications failures, infrastructure attacks or other circumstances beyond Golova Europe SL’s reasonable control;
  • Damages arising from the User’s improper or unlawful use of the Services;
  • Content made available by third parties through the Services or accessible via links to third-party websites.

Nothing in this Legal Notice limits the User’s rights as a consumer under Spanish, European or other applicable consumer protection law. The detailed liability regime applicable to the contractual relationship with Golova Europe SL is set out in the User Agreement.

8. Links to third-party sites

The Services may contain links to websites or applications operated by third parties. Golova Europe SL does not control the content, policies or operation of such third-party resources and is not liable for them. The existence of a link does not imply endorsement of the linked site or its operator. The User accesses third-party resources at their own risk.

9. Data protection and cookies

The processing of Users’ personal data is governed by the Privacy Policy.

The use of cookies and similar technologies is governed by the Cookie Policy.

10. Amendments

Golova Europe SL reserves the right to modify, at any time and without prior notice, the configuration of the Services and the content of this Legal Notice. The current version is always available at https://golova.ai/en/legal-notice. Continued use of the Services after a modification constitutes acceptance of the new version.

11. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. Any dispute arising out of or in connection with the use of the Services shall be submitted to the courts and tribunals of Barcelona, Spain — without prejudice to the right of consumer Users to bring actions before the courts of their country of habitual residence (Articles 17 to 19 of Regulation (EU) 1215/2012 — Brussels Ia).

In compliance with Regulation (EU) 524/2013 on online dispute resolution for consumer disputes, the European Commission’s Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr/. The Company does not undertake to participate in any specific out-of-court dispute resolution system unless required by mandatory law.

12. Languages

This Legal Notice is published in English as the master version. Translations into Spanish, Catalan, German, French and Brazilian Portuguese are provided for the convenience of users of those languages. In the event of any discrepancy between language versions, for business users the English version shall prevail; for consumer users, the language version in which the Services are accessed is binding.
